Terms of Service

1. Operator

KORTY ONLINE (kortyonline.pl) is operated by YASTUNING OÜ, registered at Pae 25-47, 11414 Tallinn, Estonia, company number 14016370 (registered in the Estonian Business Register - e-äriregister.rik.ee), VAT number EE102354272. Contact: [email protected].

Single point of contact for EU member state authorities under Art. 11 of Regulation (EU) 2022/2065 (DSA) and for reporting illegal content: [email protected].

2. Registration and Eligibility

• –Registration requires the user to be at least 18 years old.
• –Each person may hold one account linked to an email address.
• –The information provided must be accurate and up to date.
• –Email verification is mandatory before full access to the Platform.
• –Suspension or removal of a venue owner account may only occur in the following cases: breach of these Terms, unlawful conduct, unpaid subscription after the grace period, or a court/regulatory order. We notify the owner with stated reasons; the owner may respond to the allegations. In urgent cases (system security or illegal activity) suspension is immediate - reasons are provided without undue delay.

3. User Roles

The Platform supports two roles:

• –Player - can search for courts, create bookings, and participate in open games and matchmaking.
• –Venue owner - manages a sports venue, courts, schedule, and bookings; uses a paid subscription.

A user may hold both roles simultaneously.

4. Court Bookings

The Platform allows booking of tennis, padel, and squash courts. A booking is confirmed immediately upon submission.

1 hour before the game, the Player is required to confirm their attendance.

The free cancellation window is set individually by each venue. Cancellation terms (including any applicable fees) are displayed in the court details and before payment confirmation, in accordance with the pre-contractual information requirements of Consumer Rights Directive 2011/83/EU Art. 6(1)(l).

5. Cancellations and Reliability Score

Cancellation after the free cancellation window may be subject to a fee in accordance with the venue's policy.

Each player has a reliability score (default 100 points):

• –A no-show without cancellation deducts 15 points.
• –A confirmed attendance adds 5 points.

The score is visible to other users in the context of open games.

6. Payments

Payments for bookings are processed via Revolut, a PCI DSS Level 1 certified payment provider. KORTY ONLINE does not store full payment card data. We retain only the last four digits of the card and its expiry month/year from the payment webhook. Refunds are issued only to the original payment method, subject to the venue's cancellation policy.

7. Owner Subscription

Access to the owner panel requires an active subscription, billed monthly through Revolut. New owners receive a free trial period. Current prices are available at kortyonline.pl/en/billing/plans.

• –The subscription may be cancelled at any time; access remains active until the end of the paid period.
• –In the event of a payment issue, a 7-day grace period applies (the contract remains in arrears) before access is suspended; a payment failure notification email is sent.
• –Subscription fees are non-refundable.

Subscription invoices are issued by YASTUNING OÜ (EU VAT number: EE102354272) in EUR. Venue owners who are VAT-registered businesses in Poland account for VAT independently under the reverse charge mechanism pursuant to Art. 44 of EU VAT Directive 2006/112/EC.

The Operator may offer promotional plans (including a Founder Plan) at a temporarily reduced price. Current plan details and pricing: kortyonline.pl/en/billing/plans. Upon expiry of the promotional period, the subscription automatically switches to the current standard pricing - we notify by email at least 30 days in advance.

Venue owners acting as consumers (Art. 2(1) of Directive 2011/83/EU): By activating the subscription, you consent to the immediate start of the digital service. You confirm via a separate checkbox on the activation screen that you acknowledge the loss of your right of withdrawal upon commencement of performance, pursuant to Art. 16(m) of Directive 2011/83/EU.

Venue owners acting as businesses (B2B) do not hold consumer rights under Directive 2011/83/EU - the above paragraph on right of withdrawal does not apply to them.

8. Open Games and Matchmaking

A player booking a court may mark the game as open, allowing others to join. A participant may leave an open game in accordance with the venue's conditions.

All participants are required to observe:

• –Fair play and mutual respect.
• –The venue's rules and regulations.

9. Prohibited Conduct

The following are prohibited:

• –Submitting content that is unlawful or infringes the rights of third parties.
• –Discrimination on the basis of gender, race, nationality, religion, or sexual orientation.
• –Harassment and aggression towards other users or venue staff.
• –Attempts to gain unauthorised access to Platform systems.
• –Creating multiple accounts or accounts on behalf of others.
• –Automated collection, copying, or indexing of Platform data using scripts, bots, crawlers, or other tools (scraping) without the Operator's written consent.

10. Limitation of Liability

KORTY ONLINE acts as a disclosed intermediary (agent) connecting players with sports venues. The booking contract is concluded directly between the Player and the Venue - KORTY ONLINE facilitates the conclusion and payment, and is not a party to that contract.

The Platform is not liable for:

• –The quality of services provided by venues.
• –Cancellations on the part of venues.
• –Injuries sustained during sports activity - the user accepts the inherent risks of sport.
• –Damage resulting from force majeure events.
• –Loss of profits or indirect or consequential damages.

To the maximum extent permitted by law, the total liability of KORTY ONLINE for any claims brought by venue owners acting as businesses (B2B) is limited to the amount paid for one (1) month of subscription. This limitation does not apply to: (a) claims by users acting as consumers for damages caused by the Operator's fault; (b) personal injury claims; (c) liability for violations of data protection law (GDPR).

11. Account Deletion

Users may delete their account at any time by contacting [email protected]. Upon deletion, personal data is removed in accordance with the Privacy Policy. Invoices and billing records are an exception - personal data contained in invoices is anonymised upon account deletion, and the invoice document itself is retained in anonymised form for 7 years as required by Estonian accounting law (Raamatupidamise seadus).

12. Governing Law and Dispute Resolution

These Terms are governed by Estonian law. Under Rome I Regulation (EU) No 593/2008 Art. 6, users who are consumers retain the mandatory protection of the law of their country of habitual residence. We will endeavour to resolve disputes amicably - contact us at [email protected].

Changes to these Terms: we notify by email at least 15 days in advance (Art. 3(2) P2B Regulation). Venue owners may terminate the contract with immediate effect before changes take effect, at no additional cost.

Complaints from venue owners regarding the application of these Terms or Operator decisions (free internal system, Art. 11 P2B Regulation): [email protected] - response within 30 days.

B2B mediation: disputes with venue owners acting as businesses may be resolved out of court through: Eesti Kaubandus-Tööstuskoda (kaubanduskoda.ee) or another mediator agreed by the parties.
